General Terms

This page contains My Peau’s terms and conditions. We strongly recommend reading this before ordering any products, because purchasing from us means you agree to these terms and conditions. The version of the terms and conditions in force at the time the order is placed shall apply to the specific order.

By ordering from My Peau, you confirm that you are at least 18 years old (or have parental or legal guardian permission) and accept these terms and conditions.

If you do not agree with the terms, you should not use the My Peau website or purchase items. For the sake of clarity, it should be noted that it is not possible for you to accept these terms and conditions in part unless otherwise agreed in writing between you and My Peau.

We assume no risk or liability and shall be exempt from all liability if you have not read these terms and conditions in whole or in part, even if allowed to do so.
 

Personal Information

As stated in our Privacy Policy, all the information you provide us or we obtain in other ways is collected to ensure a smooth ordering and delivery process.
 

Payment

Until payment is made, all products remain the property of My Peau. We reserve the right not to send the items if the payment has been rejected or there are any issues regarding it.
 

The price applied to your order is the one that was set on the day the purchase was made. Shipping expenses are shown before the confirmation of the purchase. Your credit card information is not stored, so the entire payment process is completely safe and secure.
 

Please note that local charges may occur in your region. Detailed information is explained in our Delivery terms.

Delivery

Customs/import fees are not included in our services. These fees are the responsibility of the recipient and are imposed in accordance with the regulations of the country to which the goods are being shipped.

We are a customer-first company, striving to provide the best quality products with a seamless experience for you. Still, sometimes issues arise, so if there’s anything wrong with the item you have received, we will do our best to fix it and ensure your satisfaction.

Legal Right of Cancellation

You may cancel your order by contacting us at hello@mypeau.com.

Depending on where you live, you have a legal right to cancel your order under the Australian Consumer Law. This means that during a certain cancellation period, if you change your mind or for any other reason decide you do not want to keep the purchased products, you can notify us of your decision to cancel the order. If you have already received your order, you will need to return the items you wish to cancel to us. Please note that all shipping expenses for returning the item of good quality remain the responsibility of the customer.

If the order has been placed from a country outside Australia, additional fees such as customs or taxes may need to be paid for the return, and you are responsible for paying such additional costs.

WARNING: Personalized products are one of a kind and have been manufactured specifically for you. Therefore, we cannot exchange or refund any customized products under any circumstances unless the product has a manufacturer's defect.

Returned items must not have been worn or used and must be in their original condition. They will be inspected once received. Returned items must retain the labels, but the return packaging does not need to be the original shipping box. However, it is your responsibility to ensure that returned items are properly packed to prevent damage during the return journey. If a returned item arrives in inadequate condition, we will return the item to you, and in this case, we will not be able to process the refund. Refunds for returned items will be issued to the original payment method used when placing the order.

If we do not receive your cancelled order, we may arrange for recovery at your expense.

If we notice an unusual pattern of returns activity (e.g., excessive returns or items returned do not match what you ordered), we may deactivate the account and any associated accounts.

Returns and Refunds

If the items do not comply with quality requirements or you have received incorrect items, you shall have the right, in accordance with the procedure provided by law, to have the items replaced with ones of the correct quality or to receive a refund.

If you want to return a defective or incorrect item, please contact us within 30 days of receiving the order at hello@mypeau.com. If you have discovered our fault, please take pictures of the defective or incorrect item sent to you and attach them to the initial email with an explanation.

We do not issue refunds if you do not provide a reason for returning the item or if you send it back without contacting us first.

Refunds for returned items will be issued to the original payment method used when placing your order. My Peau will cover all shipping expenses for returning the defective or incorrect item.

For eyewear products, we offer free returns. If you’re not satisfied with your new frames, simply contact our customer support team within 30 days of receiving your eyewear, and they will provide you with a returns slip and instructions for sending back the product, free of charge!

The returned product must not be used and should be sent to us in its original packaging. Please write “RETURNED ITEM” on the packaging to avoid misunderstandings.

Your My Peau Account

You are responsible for the information you provide on our website.

A customer must not use the account unlawfully or in ways that may cause harm to My Peau.

We reserve the right to remove or suspend your account if we notice any signs of suspicious activity. Using someone else’s My Peau account without their permission is strictly prohibited.

Warranty

We undertake to sell you items of excellent quality. The items are guaranteed for terms provided by applicable law.

Our guarantee of quality does not limit or restrict your rights under Australian Consumer Law in the event of purchasing defective items.

My Peau offers a warranty period on all items sold on our website, covering manufacturing defects. However, please note that the warranty does not cover failures or other defects in the items not caused by us or the manufacturer. No warranty shall apply where the defect or damage is due to negligence, external influences, natural wear and tear, or improper use and care.

Use of the Website

You are prohibited from using this website for any of the following purposes:

  • Breaching any laws or uploading unlawful, vulgar, or abusive material

  • Interfering with others’ use or enjoyment of this website in a negative way

  • Copying designs or other content that is My Peau’s intellectual property

  • Using content uploaded by other customers without their permission

You must not misuse or tamper with the website, i.e., hack, introduce viruses, or carry out denial of service attacks, or otherwise interfere with My Peau’s technology or functionality, or steal My Peau’s customer data.

You will be responsible for My Peau’s losses if you breach these provisions. You also agree to indemnify, defend, and hold harmless My Peau, its directors, officers, employees, consultants, agents, and affiliates from any and all third-party claims, liability, damages, and/or costs (including legal fees) arising from your use (or misuse) of this website or your breach of these terms.

We do not warrant and shall not be liable if the website is unavailable at any time. You acknowledge that My Peau is not responsible for internet access services.

Reviews on Our Website

If you have purchased items on the website and meet the other requirements set out in this section, you shall have the right to evaluate the purchased items by leaving a review.

We take no responsibility for the content you or other buyers submit, post, or display on or via My Peau’s website.

We undertake to comply with the requirements of applicable law, these terms, and the Privacy Policy when collecting and publishing your review.

Changes

We reserve the right to change, amend, or supplement these terms and conditions at any time.

Unless otherwise provided, you shall be informed of any changes on the website, and the changes shall become effective immediately upon their publication. If you do not agree to the new terms and conditions, you should no longer use the website and should not purchase items.

Advertising and Sponsorship

This website may contain advertising or sponsorship material. You understand and agree that My Peau will not accept any responsibility for the content of third parties (hereinafter referred to as the “Content”).

We make no warranties or representations whatsoever with respect to the Content (including, without limitation, no warranty as to the accuracy of such content, and no liability for the quality of the products or services contained in the Content). You understand that any information accessed through hyperlinks to other websites is the sole responsibility of the third party who provided that Content.

Limitation of Liability

We are not liable for any loss or damage caused by your use of the purchased items if the use of the product does not comply with the applicable user guidelines and care guide and/or if the items are not handled with proper care. You are responsible for examining the items to ensure they are not defective prior to use.

Our liability for any loss or damage arising in connection with your order on our website is limited to the value of your order, unless otherwise stipulated by mandatory law. We shall under no circumstances be liable for indirect losses or damages.

Intellectual Property Rights

All content of the website, including all texts, graphics, images, photographs, any footage or visual material, trademarks, logos, and graphic design of the website, is My Peau’s or a third party’s intellectual property, protected by copyright and intellectual property laws.

By accepting these terms, you understand that by using the website and purchasing items, you do not acquire any rights to My Peau’s content and may only use it in accordance with these terms. You shall not use My Peau’s content, including but not limited to publishing, selling, renting, copying, displaying, modifying, adapting, reproducing, or using it for purposes other than personal and informational without the consent of My Peau or the third party holding the relevant intellectual property rights.

If you infringe on our intellectual property rights, you shall be liable to compensate for damages resulting from such infringement.

Notifications relating to the execution of the order shall be sent to the email and/or telephone number indicated by you. My Peau shall not be liable if you do not receive sent information or confirmation messages due to internet connection, network disruptions, or incorrect data that you provided to us.

Dispute Settlement and Applicable Law

These terms and the purchase of items shall be governed by the laws of Australia. Any disputes arising out of these terms or the sale of items shall be settled in the competent courts of Australia. Please note that we can issue legal action in the territory where the buyer has a permanent residence.

If you have a complaint, you can outline and submit it to us at the contacts specified in these terms. We undertake to respond to such claims within 14 (fourteen) calendar days from the date of receipt of the request.

If we cannot resolve the dispute, you can submit a complaint to the relevant consumer protection authority or directly to a competent court.
